Mr. Halim, the owner of an industrial organization in Tejgaon I/A and because of certain riotous conduct and disorderly behaviour of his workers, the factory manager was injured and Mr. Halim is now thinking to close down his factory.

Question:

Whether an employer can close down his industry in the above circumstances?

My Answer:

Yes, an employer can close down his industry in the above circumstances. As per The Bangladesh Labour Code, 2006 section 12 (1) we find “The employer, at any time, in the event of fire, catastrophe, break down of machinery, stoppage of power supply, epidemic, civil commotion, or any other reason beyond his control, if necessity demands, may stop any section of sections of his establishment partly or wholly and may keep the order of stoppage in force till the reason for which the order of stoppage is give exists”.
